Industrial relations systems

The industrial relations system that applies to your business, including wages and leave entitlements for staff, depends on your business structure. Whether your business operates as an incorporated entity, sole trader, unincorporated partnership, or trust, different regulations may apply.

Western Australia has two industrial relations systems: state and national The system that applies to your business depends on its structure.

Generally, the national system applies to incorporated businesses—those with ‘Pty Ltd’ or ‘Ltd’ in their name—while the state system applies to sole traders, unincorporated partnerships, and some trusts.

There is some overlap between the state and national systems. For example, termination notice and parental leave fall under the national system, while long service leave and child employment laws are regulated by the state system.
