The Western Australian Small Business Commissioner is dedicated to enhancing the operational environment for small business owners. Supported by the Small Business Development Corporation (SBDC), the Commissioner will investigate actions by private sector entities, State Government, or local government bodies that negatively impact the commercial activities of small businesses, including subcontractors.
What Constitutes Adverse Behavior Against Small Businesses?
Adverse behaviors that can harm small businesses include:
- Persistent late payments
- Failure to pay for goods or services
- Unfair contract terms or breaches of contract
- Greenwashing (misrepresenting a product or business as more environmentally friendly than it truly is)
- Black cladding (non-Aboriginal businesses exploiting Aboriginal entities or individuals to access procurement policies or contracts reserved for Aboriginal businesses)
- Any other unethical or improper conduct that adversely affects small businesses.
You do not need to reveal your identity or file a formal complaint for the Small Business Commissioner to determine whether an investigation is necessary.
Safe2Say – Anonymous Reporting Platform
Safe2Say, powered by CrimeStoppersWA, offers a secure platform to anonymously report behaviors by organizations that negatively impact small businesses. With Safe2Say, you can:
- Submit an anonymous report about conduct you believe is harming small businesses in Western Australia.
- Maintain anonymous communication with the SBDC as your case progresses.
- Use the ‘Follow Up’ feature to track the status of your report without disclosing your identity.
This platform is specifically designed for small business owners to report adverse behaviors affecting their operations.
Complaints from customers should be directed to Consumer Protection and employee issues with FairWork (national industrial relations system) or the Department of Energy, Mines, Industry Regulation and Safety (state industrial relations system).
What will the Commissioner do with your report?
The Commissioner, with the support of the SBDC’s experienced investigators, will assess your report to determine the appropriate course of action and identify the responsible party. You will be informed of the next steps within five business days of submitting your report.
At no point in this process will you be required to disclose your identity unless you choose to do so.
